Councillors Knowles, Dixon and J Rosenstiel declared  Code of Conduct (non-financial) interests in minute number 01/m/119 – “Public Entertainment Licence:  Selwyn College” – as they were friends of the applicant, Ms S V Brinton.  All remained in the room and took part in the decision.

 

01/m/114        PUBLIC ENTERTAINMENT LICENCE:  HMV LION YARD

 

The Head of Environmental Health and Waste Strategy presented a report which described an application for a Public Entertainment Licence for HMV, Lion Yard Shopping Centre.

 

The Police advised that they had no objections to the application, subject to the recommended conditions. The Fire Service, which was not represented at the meeting, had previously advised that it wished to amend conditions 3 and 6 in the report.  

 

Resolved (with no votes against) that a Public Entertainment Licence be granted for HMV, Lion Yard Shopping Centre, subject to the conditions recommended in the report including the following amendments:

 

Condition 3 to read:  “The first floor of the premises shall be closed during performances”.

 

Condition 6 to read:  “Illuminated exit signs shall be provided, one above each exit.  Number of exits –  three”.

 

01/m/115        PUBLIC ENTERTAINMENT LICENCE:  BAR MOOSH

 

The Head of Environmental Health and Waste Strategy presented a report which described an application for a Public Entertainment Licence for Bar Moosh, Station Road.

 

The Police advised that they had no objections to the application, subject to the recommended conditions. 

 

Resolved (with no votes against) that a Public Entertainment Licence be granted for Bar Moosh, Station Road, subject to the conditions recommended in the report.

 

01/m/116        PUBLIC ENTERTAINMENT LICENCE:  BORDERS

 

The Head of Environmental Health and Waste Strategy presented a report which described an application for a full Public Entertainment Licence for Borders bookshop, Market Street.  A Licence had previously been granted on a temporary basis until 18 October 2001.

 

The Police advised that they had no objections to the application, subject to the recommended conditions.

 

Siobhan Donnelly of Borders attended in support of the application. 

 

Resolved (with no votes against) that a full Public Entertainment Licence be granted for Borders bookshop, Market Street, to allow events on Monday to Saturday from 12.00 noon to 10.00pm and on Sunday from 12 noon to 5.00pm, subject to the existing conditions.

-HEADING-PUBLIC ENTERTAINMENT LICENCE:  THE LOCOMOTIVE PUBLIC HOUSE

 

The Head of Environmental Health and Waste Strategy presented a report which described an application for the renewal of the Public Entertainment Licence for the Locomotive Public House, Mill Road, including use of the rear bar for music and dancing.  A Licence had previously been granted on a temporary basis for three events only.  The Head of Environmental Health and Waste Strategy also suggested an additional condition to those recommended in the report, as follows:

 

“Doors and windows to be kept closed at all times during events”.

 

The Police advised that they had no objections to the application, subject to the recommended conditions. 

 

A local resident attended and addressed the Sub-Committee.  He said that the area was already busy, with large numbers of people passing through, and there was a problem with vandalism.  Noise from the Locomotive caused disturbance for residents of Mill Street and Covent Garden, especially when events were held in the rear bar.  The situation would need to be monitored closely.

 

The Chair responded that the situation would indeed be monitored closely.  Events would only be allowed at this stage for monitoring purposes.

 

In answer to a point made by Councillor Dixon, the Head of Environmental Health and Waste Strategy explained that the front bar was already covered by the Public Entertainment Licence, and this was not affected by the application.

 

In response to a question from Councillor J Rosenstiel, the Head of Environmental Health and Waste Strategy confirmed that the likely effect of events on local residents during the summer months would be taken into account when monitoring took place.

 

Councillor T Schofield said that the landlord should liaise with local residents.

 

Resolved (with no votes against) that the Public Entertainment Licence for the Locomotive Public House, Mill Road, be renewed, subject to the conditions recommended in the report and the following additional condition:

 

“Doors and windows to be kept closed at all times during events”.

 

01/m/118        PUBLIC ENTERTAINMENT LICENCE:  DOBBLERS PUBLIC HOUSE

 

The Head of Environmental Health and Waste Strategy presented a report which described an application for a full Public Entertainment Licence for the Dobblers Inn Public House, Sturton Street.  A Licence had previously been granted on a temporary basis for three events only.

 

The Police advised that they had no objections to the application, subject to the recommended conditions. 

 

Members were concerned to learn from the report that a local resident had complained that the landlady appeared unwilling to comply with the conditions and had no regard for her neighbours.  Members stressed that it was extremely important that applicants took into account the views of local residents in situations such as this.  The Head of Environmental Health and Waste Strategy said, however, that in his experience he had found the landlady to be cooperative.

 

In response to a question from the Chair, the Head of Environmental Health and Waste Strategy explained that, although the premises were unsuitable for a Public Entertainment Licence at present, he felt that the applicant should be given an opportunity to have an acoustic scheme designed whereby a Licence would be possible.

 

Resolved (with no votes against) that the Public Entertainment Licence for the Dobblers Inn Public House, Sturton Street, be renewed on a temporary basis, subject to the conditions recommended in the report.

 

01/m/119        PUBLIC ENTERTAINMENT LICENCE:  SELWYN COLLEGE

 

The Head of Environmental Health and Waste Strategy presented a report which described an application for a variation to the Public Entertainment Licence for Selwyn College to permit a Snow Ball, to be held between 9.00pm and 4.00am, provisionally on 30 November 2001.

 

The Police advised that they had no objections to the application, subject to the recommended conditions.

 

The President of the Selwyn College Snow Ball attended in support of the application.

 

Resolved (with no votes against) that a variation to the Public Entertainment Licence for Selwyn College be granted to permit a Snow Ball, to be held between 9.00pm and 4.00am, provisionally on 30 November 2001, subject to the conditions recommended in the report.

 

01/m/120        PUBLIC ENTERTAINMENT LICENCE:  PO NA NA FEZ CLUB

 

The Head of Environmental Health and Waste Strategy presented a report which described an application for the renewal of the Public Entertainment Licence for the Po Na Na Fez Club, Market Passage, and for a variation of the terminal hour on Sunday from midnight to 2.00am.

 

The Police advised that they had no objections to the application, subject to the recommended conditions.

 

Simon Harrow of the Po Na Na Fez Club attended in support of the application.  He acknowledged that the Sub-Committee was currently trialling a policy of allowing each nightclub in the city centre to stay open until 3.00am once a week only, on either Friday or Saturday.  However, the Po Na Na Fez Club had been allowed to stay open until 3.00am Monday to Saturday for the past 12 months.  This had proved popular with customers and had resulted in a considerable reduction in anti-social behaviour.  The Police confirmed that there had been fewer reports of incidents at the premises since the introduction of the 3.00am closing time.

 

The Chair stated that, as the current arrangements seemed to be operating well, it would be inappropriate to make any changes.

 

Resolved (with no votes against) that

 

1)     The Public Entertainment Licence for the Po Na Na Fez Club, Market Passage, be renewed on a temporary basis until 7 March 2002, subject to existing conditions.

 

2)     The application for a variation of the terminal hour on Sunday from midnight until 2.00am be refused.

 

01/m/121        PUBLIC ENTERTAINMENT LICENCE:  KAMBAR

 

The Head of Environmental Health and Waste Strategy presented a report which described an application for a variation to the Public Entertainment Licence for Kambar, Corn Exchange Street, to extend the finishing hour on Friday and Saturday until 3.00am and every other day until 2.30am.

 

The Police advised that they had no comments on the application.

 

Resolved (with no votes against) that the application be refused for the reason given in paragraph 4.1 of the report.

 

01/m/122        PUBLIC ENTERTAINMENT LICENCE:  FIFTH AVENUE

 

The Head of Environmental Health and Waste Strategy presented a report which described an application for a variation to the Public Entertainment Licence for Fifth Avenue, Petty Cury, to extend the opening hours on Friday and Saturday to 3.00am and on Sundays preceding a bank holiday (excluding Easter Sunday) to 3.00am.  He added that he had received a letter from the applicants’ solicitors requesting that the application be deferred until the next meeting, on 13 December 2001.

 

Resolved (with no votes against) that the application be deferred until the next meeting, on 13 December 2001.

 

01/m/123        PUBLIC ENTERTAINMENT LICENCE:  NEWNHAM CROFT PRIMARY SCHOOL

 

The Sub-Committee noted that the application for a Public Entertainment Licence for Newnham Croft Primary School had been withdrawn.

 

01/m/124        PUBLIC ENTERTAINMENT LICENCES: TRANSFER OF NAMES

 

The Sub-Committee noted the transfer of licensees’ names in respect of Toxic, the Cambridge Snooker Centre and Fifth Avenue, as shown on the agenda.

 

 

 

01/m/125        EXCLUSION OF THE PUBLIC

 

Resolved (with no votes against) that the public be excluded from the meeting for the next items on the grounds that if they were present there would be disclosure to them of information defined as exempt from publication by paragraphs 7 and 14 of Part I of Schedule 12a of the Local Government Act 1972.

 

01/m/126        THE STANDING OF AN INDIVIDUAL’S PRIVATE HIRE DRIVER’S, OPERATOR AND VEHICLE LICENCES AND HACKNEY CARRIAGE VEHICLE LICENCE

 

The Head of Transport Services presented a report which requested the Sub-Committee to review the standing of an individual’s Private Hire Driver’s, Operator and Vehicle Licences and Hackney Carriage Vehicle Licence in the light of a complaint submitted by a member of the public.

 

The individual concerned attended with his representative.  They addressed the Sub-Committee and answered questions.  The Head of Transport Services and the Head of Legal and Democratic Services also answered questions.

 

Resolved (with no votes against) that no further action be taken in respect of this matter (agenda item 16).

 

01/m/127        THE STANDING OF AN INDIVIDUAL’S HACKNEY CARRIAGE VEHICLE LICENCE AND HACKNEY CARRIAGE DRIVING LICENCE

 

The Head of Transport Services presented a report which requested the Sub-Committee to review the standing of an individual’s Hackney Carriage Vehicle Licence and Hackney Carriage Driving Licence in the light of a complaint submitted by a hackney carriage driver.

 

The individual concerned attended with his legal representative.  They addressed the Sub-Committee and answered questions.  The Head of Transport Services and the Head of Legal and Democratic Services also answered questions.

 

Two witnesses were called by the individual concerned.  They addressed the Sub-Committee and answered questions.

 

Resolved that

 

1)     No further action be taken in respect of this matter (agenda item 17).

 

2)     A letter be written to WAGN rail company requesting better monitoring of hackney carriage drivers using the taxi rank at Cambridge Railway Station, to ensure that it is used only by those entitled to do so.

 

01/m/128        THE STANDING OF AN INDIVIDUAL’S HACKNEY CARRIAGE VEHICLE LICENCE

 

The Head of Transport Services presented a report which requested the Sub-Committee to review the standing of an individual’s Hackney Carriage Vehicle Licence, in the light of a complaint submitted by 10 people.  This item had been deferred from the meeting on 23 August 2001.

 

Resolved (with no votes against) that the individual named in the report be given a written warning (agenda item 18).
