01/m/109        EXCLUSION OF THE PUBLIC

 

Resolved (with no votes against) that the public be excluded from the meeting for the next item on the grounds that if they were present there would be disclosure to them of information defined as exempt from publication by paragraphs 4, 7 and 12 of Part I of Schedule 12a of the Local Government Act 1972.

 

01/m/110        STANDING OF HACKNEY CARRIAGE VEHICLE LICENCES 41 AND 114

 

The Head of Transport Services and the Head of Legal and Democratic Services presented a report which requested the Sub-Committee to review the standing of Hackney Carriage Vehicle Licences 41 and 114 in the light of the information contained in the report. 

 

The individuals concerned attended with representatives.  They addressed the Sub-Committee and answered questions.  Papers relating to an ongoing court case were tabled by one of the parties present for members’ information, although these were not taken into account when the Sub-Committee took its decision.  The Head of Transport Services and the Head of Legal and Democratic Services also answered questions. 

 

Resolved that

 

1)                 The Hackney Carriage Vehicle Licences 41 and 114 be declared void, as they were issued to people who were not, in fact, the proprietors of the vehicles in respect of which the Licences were issued.

 

2)                 For the avoidance of doubt, and without prejudice to the declaration in 1) above, Hackney Carriage Vehicle Licences 41 and 114 be revoked under the Sub-Committee’s powers in section 60, Local Government (Miscellaneous Provisions) Act, 1976 on the grounds set out in the report.

 

3)                 The proprietors be required to return the plates relating to these Licences to the Council within seven days of being given notice, pursuant to section 58, Local Government (Miscellaneous Provisions) Act 1976.

 

In announcing the decision, the Chair advised that any application for a new Licence would need to be discussed with the Council’s Taxi Licensing Officers.  She added that this case had demonstrated that the Council needed to be clear on the ownership of a vehicle before issuing a Hackney Carriage Vehicle Licence.
