01/j/50                        DECLARATIONS OF INTEREST

 

Codes of Conduct (non-financial) interest were declared as follows:

A summary of decisions on applications for planning consent is set out in the appendix to these minutes. Full details of the decisions, conditions of permissions and reasons for refusals may be inspected in the Environment and Planning Department.

 

Resolved  that

 

  1. Planning applications considered by the Subcommittee be determined as set out in appendix 1 to these minutes.

 

  1. Conditions or grounds for refusal, which the subcommittee had delegated to the Director of Environment and Planning to draw up during the course of the meeting, following consultation with the Chair and Spokesperson, be as set out in appendix 2 to these minutes.

 

01/j/52                        Quarterly Report: January TO MARCH 2001

 

The report by the Director of Environment and Planning reviewed levels of performance during the fourth quarter of the financial year against agreed quality standards for those service activities of main interest to the Subcommittee, and reviewed progress on matters authorised by Planning Subcommittee.

 

Members noted that an updated information on S106 agreements had been appended to the report in compliance with a request made at the last meeting.

 

Resolved that the report be noted and the Director of Environment and Planning consider how best to deal with the Subcommittee’s comments.

 

01/j/53            EXCLUSION OF THE PUBLIC

 

Resolved (with no votes against) that the public be excluded from the meeting for the next items on the grounds that if they were present there would be disclosure to them of information defined as exempt from publication by paragraphs 12 and 13 (b) of Part I of Schedule 12a of the Local Government Act 1972.

 

01/j/46            Installation of Telecommunications Equipment/ CONSIDERATION OF COUNSEL’S OPINION AND ENFORCEMENT ACTION

 

The Director of Environment and Planning’s report reminded members of the decision at the previous meeting on 30 May 2001 which agreed that Counsel’s opinion be sought in respect of the installation of telecommunications equipment in the form of replica telegraph poles at three sites in the city by Orange Personal Communication.

 

Counsel’s advice was appended to the report and members were asked to consider this and the need for review of the current policy to allow telecommunications development in the form of replica street furniture to be considered under the prior approval procedure set out in paragraph 24 of the General Permitted Development Order.

 

Resolved that

 

1.         the previous policy in relation to the Council's interpretation of the (General Permitted Development) Order 1995 which was agreed at Environment Committee on 10 January 2000 to allow the installation of microcell telecommunication equipment in the public highway to be determined under the procedures set out in Part 24 of the GPDO in accordance with counsel's advice.

 

2.         enforcement action requiring the removal of these replica telegraph poles incorporating telecommunications equipment is not expedient and no further action is taken.

 

3.         the Chair and Spokesperson of the Environment Committee be asked to endorse this policy change pending any policy review at the next meeting of the Environment Committee in November 2001.

 

4.         future proposals under the prior approvals procedure will continue to be considered on the grounds of siting and appearance.
