01/m/14 PUBLIC ENTERTAINMENT LICENCE: THE
ALMA PUBLIC HOUSE
The Head of
Environmental Health and Waste Strategy presented a report which recommended
that a full Public Entertainment Licence be granted for the Alma Public House,
Russell Court, subject to conditions.
He recommended an additional condition to those listed in the
report: that the Licence be granted on
a temporary basis for three months, in order to give the applicant an
opportunity to demonstrate good management practice. He also read out an e-mail from one of the ward councillors,
Councillor Slatter, objecting to the granting of the Licence.
The Police
Service advised that it had received reports of only four incidents close to
the premises in the past nine months.
The Fire Service advised that a full fire alarm system would need to be
fitted if the Licence was granted.
Ryan Trbojevich
of the Alma Public House attended in support of the application. He said that three events had been held on a
trial basis and monitored by the Council, which had gone well. He had written to local residents to advise
them that the events would be taking place, and had asked them to ring him if
they had any complaints; he had received no calls. Since taking on the Licence in October 1999, he had worked hard
to build a relationship with the local community and to eradicate drugs from
the premises. There were other pubs in
the area, and so the problems experienced by local residents were not
necessarily caused by clients of the Alma.
Chris Holliday,
on behalf of the owners of the Alma, attended in support of the
application. He said that the owners
had every confidence in Mr Trbojevich and his partner. If the Licence was granted, a new
ventilation system would be required at the premises, costing around £12,000.
The owners would be prepared to help Mr Trbojevich towards the cost, although
this would be difficult to justify if the Licence was granted initially for
only three months.
Anne Anderson,
a local resident, stated that she had suffered disturbance and damage to her
property over a number of years. The
problems had abated for a while, but had recently become bad again. She had had 13 windows broken since 1984,
including one in the last month.
Mike Smith, a
local resident, said that he had also suffered disturbance: clients of the Alma often did not disperse
until midnight, music from cars could be heard until about 1.00am, and
equipment would be loaded until about 1.15am.
Even if windows and doors were kept shut, there would still be
disturbance from vibrations. When the
temporary Licence had been issued, no notice had been displayed, and so he had
not been aware of the application in time to object to it. The applicant had claimed that events would
only involve background music for older people, but punk, indie and rock music
had been advertised.
The following
points were made in answer to members’ questions:

The applicant believed that the
large majority of local residents was not against the granting of the
Licence. He felt that he had made every
effort to work with the local community.
·
No complaints had been received by
the Police regarding music from cars in the area.
·
A proper system of ventilation would
have to be fitted before the Licence was issued, even if it was granted
initially on a temporary basis.
Resolved (with no votes against) that a Public Entertainment Licence be granted
for the Alma Public House, Russell Court, on a temporary basis for three
months, subject to the conditions recommended in the report.
01/m/15 PUBLIC ENTERTAINMENT LICENCE: THE DEVONSHIRE ARMS
The Head of
Environmental Health and Waste Strategy presented a report which recommended
that the Public Entertainment Licence for the Devonshire Arms Public House,
Devonshire Road, be renewed, subject to existing conditions.
The Police Service
and the Fire Service advised that they had no objections to the application,
subject to the recommended conditions.
Resolved (with no votes against) that the Public Entertainment Licence for the
Devonshire Arms Public House, Devonshire Road, be renewed, subject to existing
conditions.
01/m/16 PUBLIC ENTERTAINMENT LICENCE: HAYMAKERS PUBLIC HOUSE
The Head of Environmental Health and Waste Strategy presented a report which recommended that the Public Entertainment Licence for the Haymakers Public House, Chesterton High Street, be renewed, subject to conditions.

and the Fire Service advised that they had no objections to the application,
subject to the recommended conditions.

PUBLIC ENTERTAINMENT LICENCE: DUKE OF ARGYLE PUBLIC HOUSE
The Head of Environmental Health and Waste Strategy
presented a report which recommended that the Public Entertainment Licence for
the Duke of Argyle Public House, Argyle Street, be renewed, subject to
conditions. He reported that a local
resident had telephoned his office to express concern at the application.
The Police Service
and the Fire Service advised that they had no objections to the application,
subject to the recommended conditions.
It was reported
that two of the ward councillors, Councillors Smart and Gilchrist, had stated
that they had no objections to the application, subject to the recommended
conditions.

The Head of
Environmental Health and Waste Strategy presented a report which recommended
that the Public Entertainment Licence for the Po Na Na Fez Club, Market
Passage, be renewed on a temporary basis until 23 August 2001, subject to
existing conditions.
The Police Service
and the Fire Service advised that they had no objections to the application,
subject to the recommended conditions.

The Head of
Environmental Health and Waste Strategy presented a report which recommended
that a Public Entertainment Licence be granted for the Queen Edith Public
House, Queen Edith’s Way, subject to conditions. He added that he had received an e-mail from one of the ward
councillors, Councillor Taylor, supporting the application.
The Police Service
and the Fire Service advised that they had no objections to the application,
subject to the recommended conditions.
Resolved (with no votes against) that a Public Entertainment Licence be granted
for the Queen Edith Public House, Queen Edith’s Way, subject to the conditions
recommended in the report.
01/m/21 PUBLIC ENTERTAINMENT LICENCE: KAMBAR
The Head of
Environmental Health and Waste Strategy presented a report which recommended
that the Public Entertainment Licence for Kambar, Corn Exchange Street, be
renewed, subject to existing conditions.
The report also recommended that an application for a variation to
extend the finishing hour on Friday and Saturday until 3.00am and every other
day until 2.30am be deferred.
The Police Service
and the Fire Service advised that they had no objections to the application,
subject to the recommended conditions.

1) The Public Entertainment Licence for Kambar, Corn Exchange Street, be
renewed, subject to existing conditions.

01/m/22 PUBLIC ENTERTAINMENT LICENCE: THE LOCOMOTIVE PUBLIC
HOUSE
The Head of
Environmental Health and Waste Strategy presented a report which recommended
that the Public Entertainment Licence for the Locomotive Public House, Mill
Road, be renewed and that a variation be granted to allow the rear bar area to
be used for music and dancing, subject to conditions.
The Police Service
and the Fire Service advised that they had no objections to the application,
subject to the recommended conditions.
Resolved (with no votes against) that the Public Entertainment Licence for the

SUPPORTERS’ CLUB
The Head of
Environmental Health and Waste Strategy presented a report which recommended
that the Public Entertainment Licence for the Cambridge United Supporters’
Club, Newmarket Road, be renewed and that permission be granted for the use of
a marquee on the Saturday evening following the Player of the Year function for
a fund-raising event, subject to conditions.
The Police Service
and the Fire Service advised that they had no objections to the application,
subject to the recommended conditions.
Resolved (with no votes against) that the Public Entertainment Licence for the

01/m/24 PUBLIC ENTERTAINMENT LICENCE: THE BOAT RACE PUBLIC HOUSE

Environmental Health and Waste Strategy presented a report which recommended
that the Public Entertainment Licence for the Boat Race Public House, East
Road, be renewed and that a variation to extend the finishing hour on two
nights per week be granted, subject to conditions.
The Police Service
and the Fire Service advised that they had no objections to the application,
subject to the recommended conditions.
Councillor J
Rosenstiel read out a letter from a local resident, Rosemary Young. The letter expressed concerns about the
application, on the grounds of potential noise increase, traffic and parking
increase, and the possible impact on the character of the area.
Mr Engel of the
Boat Race Public House attended in support of the application and answered
questions from members. He confirmed
that no alcoholic drinks would be served on the premises after 11.00pm or
consumed after 11.20pm.
Resolved (with no votes against) that
1) The Public Entertainment Licence for the Boat Race Public House, East
Road, be renewed, subject to existing conditions.
2) A variation be granted to allow two events per week to continue until
midnight, provided that there is no admission after 11.00pm and that only soft
drinks are sold after 11.00pm.
3) The Licence be reviewed at the Sub-Committee’s meeting on 23 August
2001.
01/m/25 PUBLIC ENTERTAINMENT LICENCE: VENUE
The Head of
Environmental Health and Waste Strategy presented a report which recommended
that the Public Entertainment Licence for Venue, Regent Street, be renewed and
that a variation be granted to extend the finishing hour until 1.00am and to
reduce the number of events held to 15 per year, subject to conditions.
The Police Service
and the Fire Service advised that they had no objections to the application,
subject to the recommended conditions.
Resolved (with no votes against) that the Public Entertainment Licence for Venue,
Regent Street, be renewed and that a variation be granted to extend the
finishing hour until 1.00am and to reduce the number of events held to 15 per
year, subject to existing conditions.
01/m/26 APPLICATIONS
FOR PUBLIC ENTERTAINMENT LICENCES APPROVED UNDER DELEGATED POWERS
The
Sub-Committee noted the applications for Public Entertainment Licences that had
been approved under delegated powers, as listed on the agenda.
A
recommendation had also been included on the agenda that the Sub-Committee
agree a 100% waiver of fees for the Fitzwilliam Museum. The Head of Environmental Health and Waste
Strategy apologised that this recommendation had appeared on the agenda in
error; the matter had already been dealt with in accordance with a policy set
by the Environment Committee.

ENTERTAINMENT LICENCES: DEFFERED APPLICATIONS FOR RENEWAL
The Sub-Committee
noted the applications to renew Public Entertainment Licences that were likely
to be dealt with by means of the delegation procedure but had been deferred
pending inspection of required work, as listed on the agenda.

The
Sub-Committee noted the standard conditions which were applied to all Public
Entertainment Licences for May Balls and June Events, as included with the
agenda.

The Head of
Environmental Health and Waste Strategy presented a report which recommended
that a Public Entertainment Licence be granted for the 2001 May Ball at St
Edmund’s College, subject to conditions.
The Police Service
and the Fire Service advised that they had no objections to the application,
subject to the recommended conditions.

ENTERTAINMENT LICENCES: MAY BALLS AT DARWIN COLLEGE, JESUS COLLEGE, MAGDALENE
COLLEGE AND QUEENS COLLEGE
The Head of
Environmental Health and Waste Strategy presented a report which recommended
that consideration of applications for Public Entertainment Licences for the
2001 May Balls at Darwin College, Jesus College, Magdalene College and Queens
College be deferred, as he had not been supplied with a method statement
regarding controls of sound levels in the marquees. However, since writing the report, he had received method
statements from Magdalene College and Queens College, and was therefore able to
recommend that the Licences in respect of these two Colleges be approved,
subject to conditions.
The Police Service
and the Fire Service advised that they had no objections to the applications
from Magdalene College and Queens College, subject to the recommended conditions.
Resolved (with no votes against) that

Entertainment Licences be granted for the 2001 May Balls at Magdalene College
and Queens College, subject to the conditions set out in Appendix 1 to these
minutes.

OF SEX ESTABLISHMENTS – DEALING WITH LICENCE APPLICATIONS
The Head of
Environmental Health and Waste Strategy presented a report which requested that
the Sub-Committee review its procedure for dealing with applications for
licences for sex establishments, in light of an application that had recently
been received.
Resolved (with no votes against) that the procedure for dealing with
applications for licences for sex establishments be as follows:

Objectors be allowed to make oral
representations to the Sub-Committee.
·
If the applicant agrees, the oral
representations of the objectors be heard on the same occasion as hearing from
the applicant. If the applicant does
not agree, the objectors and applicant be heard on separate occasions, but, if
possible, on the same day.

OF THE PUBLIC
Resolved (with
no votes against) that the public be excluded from the meeting for the next
item on the grounds that if they were present there would be disclosure to them
of information defined as exempt from publication by paragraph 4 of Part I of
Schedule 12a of the Local Government Act 1972.

TRADING CONSENTS
The Head of
Environmental Health and Waste Strategy and the Head of Street Services
presented a report which listed the applications for street trading pitches in
2001/02 that had been determined under delegated authority, and which made
recommendations on the remaining pitches for the Sub-Committee to determine.
A number of
applicants for the remaining pitches attended and were interviewed by the
Sub-Committee. A letter from an
existing trader relating to Pitch 23 was tabled.
Resolved (with no votes against) that
1) Street trading pitches be awarded as follows:
Pitch 7 (cold food, Guildhall Street/Market Street) Mr I Verrecchia
Pitch 22 (hot food, Drummer Street) Mr
T Grassow
Pitch 23 (non-food, Fitzroy Street) None of the applicants
was present at the meeting. The Head of
Environmental Health and Waste Strategy was therefore given deleg-ated
authority to award the pitch on a temporary basis for three months. The award of the pitch for the remainder of
the year would then be made by the Sub-Committee at a future meeting.
2) A review of all the street trading pitches in Cambridge be carried out
during the next year, with the aim of achieving a greater variety of products
for sale.
The meeting
