01/j/10                        Minutes

 

Cllr Dryden proposed that the minutes of the meeting of 15 November be amended in relation to application C/00/0582, Land at Homerton Street & Hills Road, to replace the existing head of term shown at 4 with " Controls can be achieved through the section 106 agreement to ensure that students will not have cars".

 

Resolved that the minutes of the meetings on 15 November (7 members voting in favour of their confirmation and 3 against) and the minutes of the meeting on 13 December 2000 be confirmed as a correct record without amendment.

01/j/13                        Planning Applications

 

A summary of decisions on applications for planning consent is set out in the appendix to these minutes. Full details of the decisions, conditions of permissions and reasons for refusals may be inspected in the Environment and Planning Department.

 

Resolved  that

 

  1. Planning applications considered by the Subcommittee be determined as set out in appendix 1 to these minutes.

 

  1. Conditions or grounds for refusal, which the subcommittee had delegated to the Director of Environment and Planning to draw up during the course of the meeting, following consultation with the Chair and Spokesperson, be as set out in appendix 2 to these minutes.

 

  1. The Director of Environment and Planning provide member training on parking standards issues, including the regular review of Travel for Work Plan agreements and student parking.

 

01/j/14            ILLEGAL DISPLAY OF HOARDING: TAJ TANDOORI, 64 CHERRY HINTON

 

The report by the Director of Environment and Planning summarised the circumstances surrounding the illegal display of a 48 sheet poster hoarding and another illegal advertisement for the restaurant, on the eastern elevation wall of the Taj Tandoori restaurant, 64 Cherry Hinton Road. The advertising agency, Ballantyne Agency responsible for the hoarding contended that there was evidence of display of advertisement material and signage on the wall from 1972 and as a result the advertisement did not require consent. However the officers contended the earlier permission granted had been for a small sign and the large advertisements  fell outside the permission.

 

Resolved that the Head of Legal Services be authorised to commence proceedings under the provisions of Section 224 of the Town and Country Planning Act 1990 (as amended) against Ballantyne Advertising of Toll Gate House, 98 Priory Road, Edgbaston, Birmingham, the advertising agency responsible for the illegal display of one 48 sheet poster hoarding on the eastern elevation wall of premises currently known as the Taj Tandoori restaurant, 64 Cherry Hinton Road, Cambridge, being an advertisement displayed without express or deemed consent in contravention of the Town and Country Planning (Control of Advertisements) Regulations 1992.

 

 

01/j/15            ACCESS GRANT FUND – BARNWELL BAPTIST CHURCH, HOWARD ROAD

 

The report by the Director of Environment and Planning set out an application for grant aid towards the cost of carrying out internal alterations to the existing toilets to provide 2 wheelchair disabled toilet facilities at Barnwell Baptist Church, Howard Road.

 

Resolved that £2,106 be offered towards the cost of carrying out internal alterations to provide 2 wheelchair disabled toilet facilities at Barnwell Baptist Church, Howard Road.

 

 

01/j/16            OBJECTION TO TREE WORKS APPLICATION 254/00 – 20 MILLINGTON ROAD

 

The Director of Environment and Planning reported that an objection had been received to a Conservation Area Notification to fell one sycamore tree at 20 Millington Road. The reason for the removal of the tree was that it was one of two set close together, neither of which would achieve their full natural size through insufficient space and was in any case, close to a neighbour’s garage.

 

The letter of objection to the removal of the tree from the neighbour was circulated with the report.

 

Resolved that no objection is made to the felling of one sycamore.

 

01/j/17            OBJECTION TO TREE PRESERVATION ORDER 11/00 – 4 CROSS STREET

 

The Director of Environment and Planning reported that an objection had been received to the protection, under Tree Preservation Order 11/2000, of the Judas Tree, Cercis siliquastrum)  growing at 4 Cross Street. This mature tree grew at the front of no. 4 and overhung the footpath linking Covent Garden with Glisson Road. It had become the subject of a Preservation Order following an application for its felling and the building of a new house on the site. The grounds given by the architect acting on behalf of the applicant for objecting to the Order were set out in detail in the report, together with the response by the Senior Arboricultural Officer.

 

Resolved that the City of Cambridge (4 Cross Street) Tree Preservation Order No. 11/2000 be confirmed without modification.

 

 

01/j/18            VARIATION OF S106 AGREEMENT – FORMER HOWARD MALLETT CENTRE, STURTON STREET

 

The report by the Director of Environment and Planning reminded members of the approval of a variation of the S106 Agreement for a temporary period of six months to alter the opening hours of Areas A, C and D of the former Howard Mallett Centre. The details of the purpose of the variation were set out in the report. Objections and a petition by local residents had been received and action taken in co-operation with the Management of the premises to remedy these complaints. The decision of the Licensing Subcommittee on 18 January 2001 relating to the grant and conditions of a Public Entertainment Licence was also set out in the report.

 

Resolved that approval be granted under S.106B of the Town and Country Planning Act 1990 (as amended) to permanently vary clauses 6,7 and 8 of the S.106 Agreement dated 7 December 1998 as follows:

 

1.      Clause 6 – Area A (audio editing suite) To permanently vary the opening hours to 24 hours a day, 7 days a week, subject to Area A being at all times under the supervision of Dawe Media Personnel.

2.      Clause 7 – Area D (performance rehearsals and general use by the community) To permanently vary the opening hours to 7am to 11pm (to be cleared of visitors by 11.20pm) on each day apart from those days when events are held under the Public Entertainment Licence when the premises shall be cleared of visitors by 11.30pm.

3.      Clause 8 – Area C (café/bar with performance space) To permanently vary the opening hours to 11am to 11pm (to be cleared of visitors by 11.20pm) on each day apart from those days when events are held under the Public Entertainment Licence when the premises shall be cleared of visitors by 11.30pm.

Proposal:     Loft conversion including the insertion of two dormers to the rear.   

Applicant: Mr & Mrs Lawrence

REFUSED            (by 8 votes to 1) for the following reasons:

1.      The introduction of two large dormers into a small roof would result in a design in a form that is out of proportion with, and neither in harmony with nor sympathetic to, the original dwelling.  For these reasons the proposal would be contrary to Policy BE1 and Policy BE8 of The Cambridge Local Plan (1996), advice in Planning Policy Guidance Note (PPG1) (1997) Annex A and in Draft Cambridge Roof Extension Design Guidance.

2.      The prominent position of the roof on a corner where the dormers would be very visible from the Newnham Croft Street, would make the proposal visually intrusive and would adversely affect the local townscape, neither enhancing or preserving but rather detracting from the character and appearance of the Newnham Croft Conservation Area.  For these reasons the proposal fails to recognise the constraints of the site and is contrary to the provisions of Policies SP12/10 and SP12/11 of the Cambridgeshire Structure Plan 1995, and Policies BE2, BE4 and BE32 of The Cambridge Local Plan (1996), and advice in PPG15 Planning and the Historic Environment.
